📜 Agreement to Terms

By accessing or using onVOICEly ("the App"), you represent that you are at least 18 years old and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

onVOICEly is a voice-based social platform that enables users to:

• Participate in live voice theaters
• Share voice messages and media
• Host and monetize events (paid tiers only)
• Stream to multiple platforms (paid tiers only)

👤 User Accounts

💳 Subscription and Payments

Billing

• Subscriptions are billed monthly or annually
• Prices shown in USD; local taxes may apply
• Payment processed through Apple App Store or Google Play Store
• Managed by RevenueCat

Cancellation

• Cancel anytime through your device's subscription settings
• Access continues until end of current billing period
• No refunds for partial months

Device Transfer Fee

⚠️ User Conduct

You Agree NOT To:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Harass, bully, or abuse other users
• Share explicit, violent, or illegal content
• Spam or engage in commercial solicitation
• Impersonate others or create fake accounts
• Attempt to hack or compromise the App
• Use bots or automated tools
• Share copyrighted content without permission (especially in streaming)

Consequences of Violations

• Warning for first offense
• Temporary suspension for repeat offenses
• Permanent ban for severe violations
• Legal action for illegal activity

©️ Content and Copyright

Your Content

• You retain ownership of content you create
• You grant us a license to transmit and display your content within the App
• You are responsible for content you share
• We do not monitor or pre-screen user content

Copyright Infringement (DMCA)

We comply with the Digital Millennium Copyright Act (DMCA). If you stream copyrighted content without permission, we apply a 3-strike policy:

• Strike 1 Warning + content removed
• Strike 2 Streaming suspended for 30 days
• Strike 3 Permanent streaming ban

Our Content

• The App and its design are protected by copyright
• onVOICEly name and logo are trademarks
• You may not copy, modify, or redistribute our intellectual property

📡 Streaming Features

Multi-Platform Streaming (Main / Enterprise Only)

• You are responsible for compliance with each platform's terms
• You must have rights to all content you stream
• We are not liable for DMCA claims or platform bans
• Streaming requires a stable internet connection
• We do not guarantee 100% uptime for streaming

Monetization

Ticket sales are processed through RevenueCat. You are responsible for reporting income for taxes.

🔒 Data and Privacy

Data Storage

• Free users: All data local to device
• Paid users: Optional cloud backup
• Chat messages: NOT stored on servers (ephemeral only)
• Device transfers: 24-hour temporary storage, then deleted

By using the App, you consent to our Privacy Policy. See the Privacy Policy for full details on data collection and use.

⚡ Disclaimer of Warranties

We do not guarantee:

• Uninterrupted or error-free service
• Accuracy or reliability of content
• Security of data transmission
• Compatibility with all devices
• Availability of third-party platform connections

🛡️ Limitation of Liability

To the maximum extent permitted by law, we are NOT liable for:

• Lost data or content
• Service interruptions or downtime
• Third-party platform issues (TikTok, YouTube, etc.)
• User conduct or content
• Financial losses related to streaming or monetization
• Indirect, incidental, or consequential damages

Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the App, your content or conduct, your violation of these Terms, or your violation of third-party rights (including copyright).

🔌 Third-Party Services

The App integrates with the following services. You agree to comply with each service's terms and policies:

• Apple App Store / Google Play Store
• Google Sign-In
• RevenueCat (payments)
• Supabase (database)
• Streaming platforms: TikTok, YouTube, Twitch, Facebook, Twitter/X, Instagram, Zoom

🚫 Termination

By You

• Delete your account anytime in app settings
• Cancel subscription through device settings

By Us

• We may suspend or terminate accounts for Terms violations
• We may terminate the App entirely with 30 days notice
• Termination does not entitle you to refunds

Effect of Termination

• Your right to use the App ends immediately
• Locally stored data remains on your device
• Cloud-backed data will be deleted within 30 days

🔄 Changes to Service

We reserve the right to:

• Modify or discontinue features
• Change pricing with 30 days notice
• Update these Terms at any time
• Suspend or terminate service for maintenance

Material changes will be notified via the App or email.

⚖️ Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Pennsylvania, United States, without regard to conflict of law principles.

Arbitration Agreement

Any disputes will be resolved through binding arbitration, not court litigation.

Exceptions: small claims court disputes, intellectual property disputes, and injunctive relief requests.

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action.

Miscellaneous

• Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and onVOICEly.
• Severability: If any provision is found unenforceable, remaining provisions stay in effect.
• No Waiver: Our failure to enforce a provision does not waive our right to enforce it later.
• Assignment: You may not transfer your rights. We may assign our rights to a successor.
• Force Majeure: We are not liable for delays due to circumstances beyond our control.
